Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Stablex platform (stablex.in and account.stablex.in) and related services (“Services”) operated by Alpha Street Technologies Private Limited (“Alpha Street Technologies”, “we”, “us”, or “our”).

Stablex is the brand name under which Alpha Street Technologies provides its digital asset trading services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

1. Eligibility

  • You must be at least 18 years of age and legally capable of entering into a binding contract under Indian law.
  • You must be a resident of India and not restricted from using these Services.
  • You must provide accurate, complete, and current information at all times.
  • We reserve the right to refuse or revoke access for compliance or regulatory reasons.
  • By using the Services, you represent that you meet all eligibility requirements.

2. Account, KYC & Verification

To access trading and withdrawal features, you must complete our KYC and bank account verification process.

  • Government-issued photo ID (Aadhaar, PAN, Passport, Driving Licence)
  • Proof of address and source-of-funds documentation where required
  • Bank account verification via penny-drop or equivalent method
  • Liveness or video verification where required

Deposits, trades, and withdrawals may be restricted until verification is complete and approved.

3. Prohibited Use

  • Money laundering, terrorism financing, fraud, scams, or proceeds of crime
  • Third-party deposits or withdrawals not in your own name
  • Market manipulation, wash trading, spoofing, or abusive trading
  • Exploiting bugs, vulnerabilities, or system behaviour
  • Providing false or misleading information
  • Using the Services where prohibited by law

4. Fees & Charges

Trading Fees

  • Regular tier (default): 0.3% per trade + applicable GST
  • VIP Tier 1 and above: reduced fee rates shown in your dashboard

INR Deposits & Withdrawals

  • INR deposits via bank transfer are generally free
  • INR withdrawals are processed only to verified bank accounts
  • Processing time: 1–3 business days

Crypto Withdrawals

  • Flat network fee applies per withdrawal
  • ERC-20, TRC-20, and BEP-20 supported
  • BEP-20 usually offers the lowest fee

4A. Taxes

4A.1 You are solely responsible for determining and complying with your tax obligations arising from your use of the Services, including income tax, Goods and Services Tax (GST), and any tax on gains from the transfer of Virtual Digital Assets (“VDAs”) under applicable Indian law.

4A.2 Where required under Section 194S of the Income Tax Act, 1961 (or any successor provision), we will deduct tax at source (“TDS”) at the applicable rate on qualifying transfers of VDAs executed through the Services, and remit such TDS to the Government of India in accordance with law.

4A.3 TDS deductions, where applicable, will be reflected in your transaction history and account statements. You are responsible for reconciling TDS credits against your income tax filings, including claiming credit via Form 26AS/AIS as applicable.

4A.4 We do not provide tax advice. You should consult a qualified tax professional regarding your specific obligations, including applicable GST on trading fees and income tax on VDA gains.

4A.5 We reserve the right to update our tax deduction and reporting practices to remain compliant with changes in applicable law, without prior notice, and will reflect such changes in your account statements.

5. Orders, Pricing & Execution

  • Prices displayed are indicative and may change before execution
  • You are responsible for reviewing order details before submission
  • Orders may be partially filled or remain unfilled
  • Market orders execute at best available price
  • Matched orders cannot be cancelled or reversed

6. Deposits & Withdrawals

  • Third-party INR deposits are strictly prohibited
  • Withdrawals are processed only to verified accounts
  • Crypto withdrawals may require whitelisted wallet addresses
  • Incorrect network selection may result in permanent loss of funds

6.5 Withdrawal Limits

Withdrawal limits (daily, monthly, and per-transaction) are determined by your KYC tier and are displayed in your account dashboard. These limits are subject to change at our discretion based on individual user risk assessment, transaction patterns, regulatory requirements, or other compliance considerations, and may be adjusted with or without prior notice where required for compliance or risk-management purposes. Where a limit change is not driven by an individual risk flag, we will provide reasonable advance notice via your registered email or the dashboard.

7. Reviews, Holds & Compliance Actions

7.1 We may delay, block, or reverse a transaction, or place a temporary hold on your account or balance, where we reasonably suspect a violation of these Terms, applicable law, or where required by a regulator, law enforcement agency, or court order.

7.2 Where legally permitted, we will notify you of the reason for a hold or review within 5 business days of the action being taken. We may withhold the specific reason where disclosure would prejudice an ongoing investigation or where prohibited by law (including under the Prevention of Money Laundering Act, 2002).

7.3 We will use reasonable efforts to complete a standard compliance review within 30 business days of initiating it. Reviews arising from a regulatory or law-enforcement direction, or requiring additional documentation from you, are not subject to this timeline and may take longer, including pending your submission of requested information.

7.4 You may request additional KYC documentation be reviewed on an expedited basis by contacting support@stablex.in; we do not guarantee expedited turnaround.

7.5 We may report suspicious transactions to the Financial Intelligence Unit – India (FIU-IND) and other competent authorities, and may freeze balances pursuant to a court order, regulatory direction, or law enforcement request, without prior notice to you where required by law.

7.6 Nothing in this Section obliges us to disclose information where such disclosure is prohibited under the Prevention of Money Laundering Act, 2002, or any other applicable law.

8. Risks & No Advice

  • Cryptocurrency assets are highly volatile
  • Stablex is not an investment adviser or financial institution
  • You are responsible for your own trading and tax obligations
  • Regulatory changes may affect service availability
  • Technology risks may affect transactions

8.6 Custody Arrangements

Crypto assets held on your behalf through the Services are held in custodian wallets, comprising hot, warm, and cold storage architecture, managed via a reputable, independent institutional digital asset custody provider. While we take commercially reasonable steps to secure assets, custody of digital assets carries inherent risks, including but not limited to: security breaches or unauthorised access affecting the custodian’s systems; operational failures or insolvency of the custodian; and the general risks associated with blockchain technology and private key management. In the event of a security incident, insolvency, or operational failure affecting the custodian, your ability to access or recover your assets may be delayed, limited, or, in extreme cases, lost. We do not guarantee the custodian’s solvency or the security of its systems, and our liability in connection with custody arrangements is subject to Section 10 (Limitation of Liability). Details of our current custody arrangements, including the identity of our custody provider(s), are published on our website’s security/trust page and may be updated from time to time without requiring an amendment to these Terms.

9. Intellectual Property

All content, software, trademarks, logos, and materials on the Stablex platform are the exclusive property of Alpha Street Technologies Private Limited.

10. Limitation of Liability & Indemnification

10.1 Limitation of Liability. To the maximum extent permitted by applicable law, Alpha Street Technologies Private Limited, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages.

10.2 Subject to clause 10.3, our aggregate liability to you arising out of or in connection with these Terms or the Services shall not exceed the total fees paid by you to us in the three (3) months immediately preceding the event giving rise to the claim.

10.3 Carve-outs. Nothing in this Section limits or excludes our liability for: (a) fraud or fraudulent misrepresentation; (b) gross negligence or wilful misconduct; (c) death or personal injury caused by our negligence; or (d) any liability that cannot be excluded or limited under applicable Indian law.

10.4 Indemnification. You agree to indemnify, defend, and hold harmless Alpha Street Technologies Private Limited and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your violation of any applicable law or third-party right; (c) your use or misuse of the Services; or (d) any false, inaccurate, or misleading information provided by you.

11. Termination

  • You may request account closure at any time
  • We may suspend or terminate access for policy violations
  • Pending balances are subject to compliance review

12. Governing Law & Dispute Resolution

12.1 Governing Law. These Terms are governed by and construed in accordance with the laws of India.

12.2 Internal Grievance Resolution. Before initiating any formal dispute proceeding, you agree to first raise the matter with our Grievance Officer (see Section 15) and allow 30 days for internal resolution.

12.3 Arbitration. If a dispute is not resolved under clause 12.2, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed mutually by the parties. The seat and venue of arbitration shall be Fatehabad, Haryana, and the language of arbitration shall be English.

12.4 Courts. Subject to clause 12.3, the courts at Fatehabad, Haryana shall have exclusive jurisdiction over matters not subject to arbitration, including applications for interim relief.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of revised Terms.
